The Website is meant to provide you with information about the services we support and will allow you to check on program usage by entering your mobile phone number under any program category on our home page. These Terms and Conditions explain our obligations to you, and your obligations to us in relation to the referenced programs.
SMS1 reserves the right to modify these Terms, in whole or in part, at any time. Changes to these Terms will be effective when posted. Your use of the Site or your registration to a new SMS1 supported application shall confirm your acceptance of these Terms. You acknowledge and agree that the SMS1 help website is for your personal informational use on the mobile device designated during the Registration.
In order to use the SMS1 supported Texting Applications, you must have a mobile device registered with a participating carrier or otherwise, have access to a mobile communications network for which Premium or Standard use of Text Messaging is approved including a prepaid plan as well as any access to your carrier.s data plan that might be necessary to download content, and pay any fees associated with any such access. In addition, you must provide a mobile handset or other mobile access device that is in working order and suitable for use in connection with these applications. You must be the owner of this device and either be at least eighteen years old or have the permission of your parent or guardian. The SMS1 supported applications are not intended for and may not be used by children under the age of 18. We do not knowingly collect information from children under the age of 18
BY USING THE SERVICE, YOU CONFIRM TO SMS1 supported APPLICATIONS THAT YOU ARE ABOVE THE AGE OF 18 AND ENTITLED TO ENTER INTO A VALID AND ENFORCEABLE AGREEMENT WITH US
The applications supported by SMS1 are committed to the privacy of their customers and no information will be shared with outside sources. You agree to release, indemnify, defend and hold harmless SMS1 Customer Support Site, its parent companies, subsidiaries, and affiliates, together with their respective officers, directors, shareholders, contractors, agents, employees, licensors and assigns from and against all liabilities, claims, damages, costs and expenses (including reasonable attorneys' fees and costs) arising out of or in connection with your use of this Site and its SMS1 supported applications.
You agree to pay your mobile device operator the any fees that correspond to the SMS1 supported Application(s) you select in accordance with the fees in effect at the time of your acceptance. Unless otherwise indicated, the charges shall be invoiced on the bill from your participating mobile carrier. The fees and terms of payment are made available through your handset, in the Specific Terms, on the Site or as otherwise disclosed to you. You agree to pay for the SMS1 supported application and the use thereof in accordance with the fees applicable from time to time. Unless otherwise indicated, the charges will be invoiced on your mobile operator.s bill, in other words on the bill related to the use of the mobile registration with which you have accessed the SMS1 supported applications
By sending the "Y" or "YES" confirmation back to the shortcode in a reply message, you are accepting the charges for the selected program. Prices include but are not limited to $.25, $.50, $.99, or $1.99 (depending on application selected) per message received; or in some cases $6.99, $9.99 or $19.99 per month for monthly subscriptions, billed directly to your wireless bill or deducted from your prepaid account. Msg&data rates may apply. Your phone must have text messaging capability to use these services. To check your usage history with us, click on the "Prices" tab and enter your phone number and shortcode used.
On standard rated programs, only the standard message fees charged by your carrier's plan will apply. These are noted by the phrase "Msg&data rates may apply", and will show on your monthly cell phone bill.
You may stop any of these services at any time by sending a text message with STOP, END or QUIT to the program's short code. To opt out by email or for additional customer support services, click the "Support" tab on this website. You can also call us at 866-358-7327 for additional help or information.
